Who we are

Christmas Photo AI is operated by an individual developer. In these terms, "we", "us", and "our" mean that operator. You can reach us at support@christmasphotoai.com.

The service

Christmas Photo AI turns a photo you upload into an AI-generated holiday portrait. You upload a JPG, PNG, or WebP photo up to 10 MB, choose one of the published styles and a format (portrait, square, or story), and we send the photo and the style instructions to the gpt-image-2.5 image model. The result is stored privately in your account and can be downloaded from the result page.

We may add, change, or retire styles, formats, and features. We do not guarantee that a particular style will stay available.

Credits and pricing

We sell one-time credit packs in US dollars: Starter (3 credits) for USD 4.99, Popular (10 credits) for USD 9.99, and Family (25 credits) for USD 19.99. Current prices are shown on the pricing page before checkout, and the payment provider shows the final amount before you pay.

One standard portrait generation costs one credit. Any other cost is shown before you confirm.

There is no subscription and no automatic renewal. Credits do not expire, cannot be transferred, and have no cash value. A new account receives one free credit for a first portrait.

We may change prices and pack contents for future purchases. A change never affects credits you already bought.

Payment, taxes, and receipts

Payments are processed by Waffo Pancake, which acts as the merchant of record and handles card processing, sales tax, and receipts. Your card statement may show Waffo or a Waffo descriptor.

Receipts are sent to the email address on your account. Our support address, support@christmasphotoai.com, also appears on your receipts.

Refunds and cancellations

There is no subscription, so there is nothing to cancel. You can stop using the service at any time.

Unused credits: you may request a full refund within 14 days of purchase if none of the credits in that pack have been used. Used credits are non-refundable.

Failed generations: if we cannot produce a result, the reserved credit is returned automatically. If a failed generation is not refunded, contact us within 30 days.

Refunds are issued to the original payment method through Waffo. The full policy is published at christmasphotoai.com/refunds.

Your photo and permissions

Upload only photos you own or have permission to use. If another person appears in the photo, you must have their consent. If a minor appears, you must be the minor's parent or guardian, or have the consent of their parent or guardian.

Do not upload photos of public figures or celebrities for transformation, or photos you found online without permission.

You keep ownership of your photo. You grant us a limited, non-exclusive licence to store, process, transmit to our image-generation and moderation providers, and display the photo only to provide the service to you.

AI-generated results

Every result is generated by an AI model, gpt-image-2.5. Results may differ from your photo, may change or invent details, and may contain visual artifacts or inaccuracies. A result is not a photograph of a real event and must not be presented as one.

When you share a result, label it as AI-generated. Do not use a result to impersonate a real person, to suggest that a real person said or did something, or in any way that could mislead other people.

We may refuse to generate, or withhold, a result that our safety checks or our review find to violate these terms or the Acceptable Use Policy.

Acceptable use

You must follow our Acceptable Use Policy at christmasphotoai.com/acceptable-use. It lists the prohibited content categories (sexual and NSFW content, violence and gore, hate, child sexual abuse material, deepfakes and impersonation, and copyright or trademark infringement) and the enforcement and reporting rules.

Moderation and enforcement

We run automated image-safety checks on uploaded photos and on generated results before they are shown to you. Reports from users are reviewed by a person.

If content violates these terms or the Acceptable Use Policy, we may refuse generation, remove content, withhold credits, suspend or terminate the account, and report the matter to the relevant authorities. We may keep records of moderation decisions as required for safety and legal compliance.

Account suspension and termination

You may stop using the service at any time. We may suspend or terminate your account if you violate these terms, if we are required to by law, or if your use creates a security, legal, or payment risk.

If we terminate your account for a violation, unused credits may be forfeited. If we terminate for a reason that is not your fault, we will refund unused credits.

Disclaimers and limitation of liability

The service is provided on an "as is" and "as available" basis. We do not guarantee that a result will resemble you or any other person, that the service will be uninterrupted, or that every style will be available.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim relating to the service will not exceed the amount you paid us during the 12 months before the claim.

Nothing in these terms limits rights you have under mandatory consumer law.

Intellectual property and third-party models

The Christmas Photo AI name, site, and service are ours. The gpt-image-2.5 model is provided by a third party; we do not claim any affiliation with, sponsorship by, or endorsement from its provider.

You may use your results for personal projects and gifts. Commercial use, resale, print runs, or use in advertising requires our written permission.

Changes to these terms

We may update these terms as the service changes. We will update the effective date at the top of this page and, for material changes, notify you by email or on the site. Continued use after the effective date means you accept the updated terms.

Governing law and contact

These terms are governed by the laws that apply at our place of business, without regard to conflict-of-law rules. Mandatory consumer protections in your country still apply.
